Pham, also known as Thanh Quang Pham, (Pham) appeals from the Judgment of Conviction and Probation filed on August 26, 2005 in the Circuit Court of the First Circuit (circuit court).On appeal, Pham argues that the circuit court erred in (1) denying "Defendants Motion to Dismiss Charges for Violation of Right to Speedy Trial With Prejudice" (Motion to Dismiss), filed pursuant to Hawaii Rules of Penal Procedure (HRPP) Rule 48, and (2) admitting testimony that Pham had used drugs in the past.
